Construction (Head Protection) Regs 1989

 

The above legislation applies to ‘building operations’ and ‘works of engineering construction’ as defined by the Factories Act 1961

Every employer must provide, maintain and replace (as appropriate) suitable head protection. Similar duties are also placed on the self employed people. An assessment should be carried out to determine what suitable head protection is required. Storage must be provided for headgear when not in use.

All employers have the duty to ensure that hear protection is worn unless there is no other foreseeable risk of injury excluding falling.

The person in control of the site may make rules regulating the wearing of suitable head protection. This must be in writing.

Every employee who has been provided with head protection must wear it when required to do so by rules written under Reg 5. All employees must take reasonable care of head protection and report any loss or damage.
